These Terms and Conditions (hereinafter referred to as « T&C ») govern the legal framework for providing access to the BrickAssist application as well as the BrickAssist.com website, and define the conditions for accessing and using the services by the « User. »

These T&C will always be accessible on the website under the « Terms and Conditions » section.

By registering or using the application, the user unconditionally accepts these T&C without reservation or limitation. When signing up via the Registration Form, each user explicitly accepts these T&C upon account creation.

In the event of non-acceptance of the T&C outlined in this agreement, the User must refrain from accessing the services provided by the application.

BrickAssist reserves the right to unilaterally and at any time modify the content of these T&C.

Article 1: Legal Notice

The publication and management of the BrickAssist application is overseen by Sébastien TURREL, located in Paris, 75012.

The hosting provider for the BrickAssist website is OVH, a company based in France at the following address: 2 Rue Kellermann, 59100 Roubaix.

Article 2: Access to the Application

The BrickAssist application provides the User with free access to the following services:

  • Organize/manage their brick inventory
  • Search for specific colors and pieces
  • Easily search for parts within their stock
  • Know the content of PABs (Pick a Brick) around the world

The application is freely accessible to any User with an Internet connection, from anywhere. All costs incurred by the User to access the service (hardware, software, Internet connection, etc.) are the User’s responsibility.

Non-members do not have access to reserved services. To access these services, they must register by completing the form. By accepting to register for reserved services, the User agrees to provide truthful and accurate information regarding their personal details and contact information, including their email address.

To access the services, the User must then log in using the email address provided during registration.

Any registered User can also request to unsubscribe by visiting the dedicated page in their personal space. The request will be processed within a reasonable timeframe or can be made directly by emailing sebastien.turrel@brickassist.com.

Any event due to force majeure that causes a malfunction of the website, application, or server, and any interruptions or modifications due to maintenance, shall not hold BrickAssist responsible. In such cases, the User agrees not to hold the publisher accountable for any service interruption or suspension, even without prior notice.

The User can contact the site via email at the email address provided in ARTICLE 1.

Article 3: Data Collection

The website and the application are exempt from declaration to the French National Commission on Informatics and Liberty (CNIL) as they do not collect any data concerning the Users.

Article 4: Intellectual Property

The brands, logos, signs, and all content on the website and the application are protected by the Intellectual Property Code, particularly by copyright law.

The User must request prior permission from the site for any reproduction, publication, or copying of the various contents. The User agrees to use the site’s content strictly for personal use; any commercial or advertising use is strictly prohibited.

Any total or partial representation of the BrickAssist website or application by any means, without the express permission of BrickAssist, would constitute an infringement punishable under Articles L 335-2 and following of the Intellectual Property Code.

It is reminded, in accordance with Article L122-5 of the Intellectual Property Code, that the User who reproduces, copies, or publishes protected content must cite the author and source.

Article 5: Liability

The sources of the information provided on the BrickAssist application are deemed reliable, but it does not guarantee that the application is free from defects, errors, or omissions.

The information provided is presented for general informational purposes only and holds no contractual value. Despite regular updates, the BrickAssist application cannot be held responsible for any changes occurring after publication. Similarly, the application cannot be held liable for the use or interpretation of the information contained within it.

The User is responsible for keeping their email account access confidential. Any disclosure of their password for accessing it, in any form, should be avoided. The User assumes the risks related to the use of their credentials. BrickAssist disclaims any liability.

BrickAssist cannot be held responsible for any viruses that may infect the User’s computer or any other electronic device as a result of using, accessing, or downloading from its website.

The liability of the application cannot be engaged in the event of force majeure or due to the unforeseeable and insurmountable actions of a third party.

Article 6: Hyperlinks

Hyperlinks may be present in the application. BrickAssist has no control over the web pages these links lead to and cannot, under any circumstances, be held responsible for their content.

Article 7: Cookies

The BrickAssist website does not contain any cookies.

Cookies are small files temporarily stored on the User’s computer hard drive by their browser and are necessary for using the BrickAssist website. Cookies do not contain any personal information and cannot be used to identify someone. A cookie contains a unique, randomly generated, and thus anonymous identifier. Some cookies expire at the end of the User’s visit, while others remain. The information contained in cookies is used to improve the website.

Article 8: Applicable Law and Competent Jurisdiction

French law applies to this contract. In the absence of an amicable resolution of a dispute between the parties, French courts shall have exclusive jurisdiction to hear the case.
